## AGREEMENT TO TERMS
These Terms and Conditions ("Terms") constitute a legally binding agreement made between you ("you," "your") and ResitMudah ("we," "us," "our," "the Developer"), concerning your access to and use of the ResitMudah mobile application (the "App").
You agree that by downloading, installing, accessing, or using the App, you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the App and you must discontinue use immediately.

## 1. ELIGIBILITY
You must be at least **13 years of age** to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App and they have read and agreed to these Terms on your behalf.
By using the App, you represent and warrant that:
- You are not located in a country that is subject to a US or Malaysian government embargo
- You are not on any list of prohibited or restricted parties
- You will not use the App for any illegal purpose

## 2. SUBSCRIPTION PLANS AND PAYMENTS
### 2.1 Subscription Tiers
The App offers the following subscription tiers:

### 2.2 Payment and Billing
- All subscription payments are processed through **Google Play Store**
- Payment will be charged to your Google Play Account at confirmation of purchase
- Subscriptions **automatically renew** unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions through your **Google Play Store account settings**
### 2.3 Subscription Changes (Upgrade/Downgrade)

| **Downgrade** (Premium → Basic) | Takes effect at next billing cycle. No partial refunds. |
| **Cancel** | Takes effect at end of current billing period. Premium features remain until then. |
### 2.4 Refund Policy
- All sales are final through the Google Play Store
- Refunds are subject to **Google Play Store's refund policies** only
- We cannot issue direct refunds. Contact Google Play Support for refund requests.
- If you cancel your subscription, you will continue to have access to premium features **until the end of your current billing period**
### 2.5 EU/UK Right of Withdrawal (14-Day Cooling-Off Period)
If you are a consumer in the European Union or United Kingdom:
- You have the right to withdraw from this contract within **14 days** without giving any reason
- The withdrawal period expires 14 days after the day of the initial purchase
- To exercise the right of withdrawal, email **ticherhaz@gmail.com** with your order details
- If you use the premium features during the 14-day period, you acknowledge that you lose your right of withdrawal (as permitted by law)

## 3. ADVERTISEMENTS
### 3.1 Ad Display
- **Free-tier users** will see advertisements displayed through Google AdMob
- **All premium subscription tiers** (Basic, Premium, Business) are **completely ad-free**
- We may display promotional messages about our subscription plans to free-tier users
### 3.2 Third-Party Advertisers
- Advertisements may be served by third-party advertising companies
- These companies may use information about your visits to this and other apps to provide advertisements about goods and services that may interest you
- You can **opt-out of personalized advertising** through:
- Device Settings → Google → Ads → Opt out of Ads Personalization
- Resetting your Advertising ID
### 3.3 No Endorsement
We do not endorse any products or services advertised in the App. Your interactions with advertisers are solely between you and the advertiser.

## 4. USER RESPONSIBILITIES AND ACCEPTABLE USE
### 4.1 License to Use
We grant you a **limited, non-exclusive, non-transferable, revocable license** to use the App for your personal or business use, subject to these Terms and your subscription tier limitations.
### 4.2 Your Responsibilities
You agree to:
- Provide accurate information and maintain its accuracy
- Keep your device and access to the App secure
- Be responsible for all activities that occur under your use of the App
- Comply with the limitations of your subscription tier
- **Verify the accuracy** of all AI/OCR extracted receipt data before relying on it
### 4.3 Prohibited Activities
You may **not**:

| Upload any content that is unlawful, offensive, or infringes on any third party's intellectual property rights | You must own or have rights to the receipts you upload |
| Circumvent subscription limitations or attempt to access premium features without payment | No hacking, cracking, or sharing credentials |
| Share your subscription credentials or allow others to access premium features through your account | One account per user |
| Use the App for tax fraud, expense fraud, or any financial misrepresentation | You are solely responsible for the accuracy of your data |

## 5. AI/OCR SERVICE DISCLAIMER
**IMPORTANT: The App uses Artificial Intelligence (AI) and Optical Character Recognition (OCR) to extract text from receipt images.**
You acknowledge and agree that:

| **Not 100% Accurate** | AI/OCR technology may make mistakes, including misreading numbers, dates, amounts, or store names |
| **You Are Responsible** | You must verify all extracted data for accuracy before using it for any purpose (tax, accounting, reimbursement, etc.) |
| **No Financial Advice** | The App does not provide tax, legal, or financial advice. Consult a qualified professional for important decisions. |
| **Data Processing** | Your receipt images are sent to a third-party AI/OCR service provider for processing. See our Privacy Policy for details. |
| **No Liability** | We are not liable for any losses resulting from inaccurate OCR extraction. |
**We strongly recommend manually reviewing all scanned receipts before relying on the data.**

## 6. DATA PRIVACY AND SECURITY
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our **Privacy Policy**, which is incorporated into these Terms by reference. Please review it to understand our practices.
You acknowledge that:

| **Usage Data** | We may collect usage data to improve the App and deliver advertisements (free tier only) |
| **Data Deletion** | You can delete your data anytime via Profile → Delete Account or email request |

## 7. INTELLECTUAL PROPERTY
### 7.1 Our Property
The App, including its source code, database, features, design, and all content (excluding User Content), are the exclusive property of the Developer and are protected by copyright, trademark, and other intellectual property laws.
### 7.2 Your Property (User Content)
You **retain all rights** to the receipts, images, and data you upload to the App ("User Content"). By uploading User Content, you grant us a **worldwide, royalty-free license** to use, host, and process this content solely for the purpose of operating, providing, and improving the App. This includes, but is not limited to, transmitting your receipt images to our third-party AI/OCR service providers to extract text data.
### 7.3 Feedback
If you provide us with any feedback, suggestions, or ideas about the App, you agree that we may use them without any restriction or compensation to you.

## 8. THIRD-PARTY SERVICES
The App integrates with the following third-party services:

## 9. DISCLAIMER OF WARRANTIES
**THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.**
**WE DO NOT WARRANT THAT:**
- The App will be uninterrupted, error-free, or free from harmful components
- The AI/OCR receipt scanning will be 100% accurate
- Any errors or defects will be corrected
- The App is compatible with all devices or operating systems
- Your data will never be lost or corrupted
**WE SPECIFICALLY DISCLAIM ANY RESPONSIBILITY FOR:**

## 10. LIMITATION OF LIABILITY
**TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:**
- Your use or inability to use the App
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the App
- Any bugs, viruses, or the like that may be transmitted to or through the App by any third party
- Any errors or inaccuracies in the receipt data extracted by AI/OCR
- Any advertisements displayed in the App
- Any issues related to subscription payments or billing through Google Play
**IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST 12 MONTHS, OR RM50.00 (FIFTY MALAYSIAN RINGGIT), WHICHEVER IS GREATER.**
**THIS LIMITATION OF LIABILITY SHALL APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.**

## 11. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including attorney's fees) arising from:
- Your use of and access to the App
- Your violation of any of these Terms
- Your violation of any third-party right, including any intellectual property or privacy right
- Any inaccurate or misleading receipt data you submit
- Your interaction with any advertisements
- Any tax, legal, or financial consequences resulting from your use of the App

## 12. FORCE MAJEURE
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, power outages, server outages, internet outages, or failures of third-party service providers (including Google Play, cloud providers, and AI/OCR providers).

## 13. TERMINATION
### 13.1 Termination by Us
We may terminate or suspend your access to the App **immediately, without prior notice or liability**, for any reason whatsoever, including, without limitation, if you breach these Terms.
### 13.2 Effect of Termination
Upon termination:

| Premium features lost | You will lose access to all premium features |
| No refund | You will not be entitled to any refund of subscription fees (prorated or otherwise) |
| Data deletion | We may delete your data in accordance with our Privacy Policy |
### 13.3 Termination by You
If you wish to terminate your account, you may:
- Simply stop using the App and delete it from your device
- Or go to **Profile → Delete Account** to permanently delete your data
**Note:** Cancelling your subscription does **NOT** automatically delete your data. You must delete your account separately if you want data removed.

## 14. DATA RETENTION AFTER TERMINATION

| You cancel subscription but keep account | Your receipts remain. You revert to Free tier limits. |
| You delete your account (Profile → Delete Account) | All data permanently deleted within 30 days. Cannot be recovered. |
| We terminate your account for breach | Data may be deleted immediately. No guarantee of recovery. |
| You stop using App without deleting account | Data remains stored for 12 months of inactivity, then deleted. |

## 15. GOVERNING LAW AND DISPUTE RESOLUTION
### 15.1 Governing Law
These Terms shall be governed by the laws of **Malaysia**, without regard to its conflict of law provisions.
### 15.2 Dispute Resolution
Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through **informal negotiation** within 30 days. If unresolved, the dispute shall be resolved exclusively in the courts located in **Selangor, Malaysia**.
### 15.3 No Class Actions
You agree to resolve any disputes on an **individual basis** and waive the right to participate in any class action or class arbitration.

## 16. CHANGES TO TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
**For material changes:**
- We will provide at least **30 days' notice** prior to any new terms taking effect
- Notice will be provided via in-app notification and/or email (if you have provided one)
- What constitutes a material change will be determined at our sole discretion
**For non-material changes:**
- We will update the "Last Updated" date
- Changes are effective immediately
**By continuing to access or use our App after revisions become effective, you agree to be bound by the revised terms.** If you do not agree, you must stop using the App and delete your account.

## 17. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provision shall be deleted or modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

## 18. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the **entire agreement** between you and ResitMudah regarding your use of the App and supersede all prior agreements, understandings, or representations.
